Last year, a Black FedEx employee was shot at by two white men while delivering packages in Brookhaven, Mississippi. After a year of paid leave and treatment for PTSD, D'Monterrio Gibson, 25, received a notification that FedEx had terminated his employment.
“FedEx has been the poster child of what not to do when your employee was almost killed on the job,” Gibson's lawyer Carlos Moore told The Washington Post.
FedEx Driver Fired
In January of 2022, Gibson was making evening deliveries in a Brookhaven neighborhood when a white pickup truck tried to cut him off. He swerved around the truck, only to be stopped by a man in the middle of the street pointing a gun at him. The second man began firing shots at Gibson, who swerved around him and continued down the street.
As Gibson attempted his escape, the white pickup truck continued to pursue him from behind. “I just went as fast as I could. He chased me all the way to the interstate,” Gibson told Mississippi Free Press.
Gibson called police dispatch to report the incident, and was informed that they had already received a report about a suspicious person at the address he was delivering to.
"Sir, I’m not a suspicious person, I work for FedEx. I was just doing my job," Gibson said.
Instead of taking Gibson's case seriously, Brookhaven's police chief tried to emphasize how "unracist" the town was.
Brandon and Gregory Case, the white father-son duo that shot at Gibson, were charged with attempted first-degree murder. But improper testimony from Brookhaven Police Detective Vincent Fernando led to a mistrial for the attempted murder charges.
The BPD withheld "potentially crucial" evidence, Moore said, via Associated Press. “We believe that this is not an isolated incident but a part of a larger pattern of obstruction by BPD.”
Only a few days later, FedEx fired Gibson for declining a non-driver position. At the time, however, Gibson was focusing on recovery, and Moore said Gibson was not aware of whether they had given him a deadline to accept the position.
“It’s despicable that FedEx has not shown compassion or human decency toward this faithful employee, D’Monterrio Gibson,” Moore said of Gibson's firing.
